Passenger Transportation and Transfer Service Agreement
This agreement has been prepared to define the terms of use, the rights and obligations of the parties, the reservation principles, cancellation rules, and the scope of service regarding private transfers, airport transportation, and passenger transfer services provided by AYT VIP TRANSFERS.
1. Parties
In this agreement, the service provider shall be referred to as AYT VIP TRANSFERS. The person who purchases the service, makes the reservation, or on whose behalf the reservation is made shall hereinafter be referred to as the Customer or Passenger.
2. Subject of the Agreement
The subject of this agreement is to determine the procedures and principles regarding the provision of private transfer services, for a fee, from the address specified by the customer to the airport, from the airport to the accommodation address, or to another transfer point purchased through the system. AYT VIP TRANSFERS agrees to provide the transfer service under the conditions specified in the reservation details, and the customer agrees to provide accurate information during booking and to pay the service fee.
3. Service Fee and Payment Terms
3.1. The service fee specified during the reservation process shall be applied as displayed on the system, unless otherwise expressly stated, including all related charges, taxes, and additional services.
3.2. In private transfer services, requests for additional stops, off-route destinations, unplanned waiting, or different pick-up/drop-off points not included in the reservation may be subject to additional charges, depending on operational availability. Short additional stops along the route without waiting time may be included upon company approval, while requests outside the route may incur extra fees.
3.3. Due to operational necessity, technical requirements, vehicle breakdown, regional congestion, or similar reasons, AYT VIP TRANSFERS may assign another vehicle of the same segment or equivalent service standard, provided that the customer is informed. If the customer does not accept such a change, the reservation may be cancelled and the unused portion of the paid amount may be refunded. This situation does not create any additional right to compensation.
3.4. The customer agrees that payment may be collected according to the payment method selected during the reservation process, including credit card, bank transfer, EFT, cash payment, or any other payment methods offered by the system.
3.5. Invoices related to the service shall be issued within the legal time limits in accordance with the applicable tax legislation.
Payment methods: Bank transfer, credit card, cash payment in the vehicle, and other payment methods supported by the system.
4. Transfer Type
The service may be provided as a one-way or round-trip transfer, depending on the reservation details. If a round-trip service is purchased, each direction shall be treated as a separate operation and planned according to the relevant time, date, and passenger details.
5. Vehicle Type
The vehicle type shall be planned according to the category selected by the customer during the reservation process, such as sedan, VIP vehicle, minibus, midibus, or similar segments. The assigned vehicle shall be determined based on the number of passengers, luggage capacity, and the class of service purchased.
6. Number of Passengers and Notification Obligation
The customer is obliged to provide complete and accurate information regarding the number of passengers participating in the transfer. If the number of passengers, amount of luggage, or additional equipment to be carried is inaccurately or incompletely declared during the reservation, it may not be possible to provide the service under the planned conditions. In such cases, AYT VIP TRANSFERS shall not be held responsible for any resulting disruptions.
7. General Provisions
7.1. All passengers are required to wear seat belts inside the vehicle in accordance with the applicable highway traffic regulations. Each passenger shall be personally responsible for the consequences of any behavior contrary to safety rules.
7.2. Even if the customer completes the reservation through the website, online payment system, virtual POS, mail order, bank transfer, EFT, or a similar method, the customer shall be deemed to have read, understood, and accepted all articles of this agreement. The absence of a handwritten signature shall not affect the validity of the agreement.
7.3. In order to benefit from the transfer service, the reservation must be completed at least 12 hours before the transfer time under normal conditions. During public holidays, religious holidays, New Year periods, high season, or unusual traffic intensity, reservations are recommended at least 48 hours in advance, and the company may apply earlier booking requirements during such periods.
7.4. Cancellation requests for transfer services shall be evaluated if submitted at least 12 hours before the transfer time. In cancellations made after this period, or in cases where the service cannot be carried out because the customer is not ready on time, a refund may not be issued. Cancellation and change rights may also be restricted for campaign, promotional, discounted, or special-price reservations.
7.5. The transfer route shall be determined by AYT VIP TRANSFERS by taking into account traffic density, road conditions, safety, regional regulations, weather conditions, official inspections, and operational efficiency. The customer’s request for unplanned stops on the route, detours to different locations, or waiting at a specific point shall be subject to the company’s approval.
7.6. The main obligation of AYT VIP TRANSFERS is to transport the passenger safely and as planned from the departure point specified in the reservation to the destination point. The company organizes suitable vehicles according to the number of passengers and luggage capacity in Antalya, Muğla, İzmir, Istanbul, and other regions where services are provided.
7.7. Vehicles assigned to the service shall have the mandatory traffic insurance, regular maintenance, and legally required equipment in full. Spare tire, reflector, first aid kit, fire extinguisher, and similar mandatory safety equipment shall be provided in the vehicle.
7.8. In the event of delays caused by traffic accidents, third-party fault, road closures, adverse weather conditions, official procedures, vehicle breakdowns, technical problems, sudden illness of the passenger, changes in flight schedules, or other external reasons, AYT VIP TRANSFERS shall only be liable to the extent expressly required by applicable law and this agreement.
7.9. If the actual number of passengers or the luggage load exceeds the amount declared during the reservation, legal transportation limits may not be exceeded. Excess passengers or luggage exceeding the vehicle capacity may not be accepted. In such cases, if the transfer cannot be partially or fully performed, no refund may be made.
7.10. The customer must present identification and reservation information to the driver or company personnel to verify that the reservation belongs to them. If identity verification cannot be completed or the reservation details do not match, the service may be refused.
7.11. Changes in flight schedules, cancellations, delays, terminal changes, or baggage claim delays caused by airlines shall not be the responsibility of AYT VIP TRANSFERS unless directly caused by the company’s fault. The customer must provide flight information as accurately and up to date as possible.
7.12. The company shall not be directly responsible for the loss, damage, or delayed delivery of personal belongings forgotten or left inside the vehicle. However, if the forgotten item is identified by company personnel, it may be returned to the customer upon request and subject to operational availability, with an additional delivery fee.
7.13. Sacks, crates, boxes, commercial goods, non-standard packaging, items that create transportation risks, or large-volume items not declared in advance may not be accepted as luggage. All luggage shall be evaluated within the scope of vehicle capacity and safe transportation conditions.
7.14. The customer accepts, declares, and undertakes that the luggage does not contain any flammable, explosive, sharp, piercing, toxic, radioactive, prohibited, illegal, narcotic, or otherwise unlawful substances under the laws of the Republic of Türkiye. The driver reserves the right to refuse any suspicious item or luggage.
7.15. If prohibited or dangerous substances are detected, and as a result luggage must be removed from the vehicle, the transfer is delayed, the journey is cancelled, or the customer misses a flight, the customer may not claim a refund, damages, or any other compensation from AYT VIP TRANSFERS. The company may notify the competent authorities when necessary.
7.16. In the event that law enforcement inspections, searches, or investigations during the transfer reveal issues related to the contents of the luggage, the legal and financial responsibility shall belong to the customer. The company reserves the right to claim direct damages caused by such circumstances.
7.17. Transportation of pets may only be considered if declared in advance during the reservation process. The type, number, and transportation method of the pet must be specified beforehand. Pets brought without prior notice may be refused.
7.18. Pets shall be transported only in compliance with legal transportation conditions and on the condition that the owner assumes full responsibility. If there is no suitable cage, pet carrier, or protective equipment, the animal may not be accepted. Animals whose possession or transportation is prohibited by law shall never be transported.
7.19. AYT VIP TRANSFERS shall make the necessary arrangements for the vehicle to be ready at the scheduled pick-up point and time. However, short delays may occur due to traffic, security checks, site entrance procedures, weather conditions, official applications, or similar external factors.
7.20. A reasonable delay period is generally considered to be 15 minutes from the scheduled transfer time. However, delays caused by residential compounds, hotels, secured areas, airport congestion, or official practices shall be interpreted separately according to the nature of the event.
7.21. The customer must be ready at the specified pick-up point at the transfer time and be reachable by the driver with their luggage. If the passenger is late, does not answer phone calls, waits at the wrong location, or is unreachable, the driver shall wait for a reasonable period; after this period, the operation may be terminated.
7.22. The driver is not obliged to leave the vehicle to enter a building, collect the passenger from a room, carry luggage over a long distance, search for the passenger within a residential compound, physically escort the passenger, or personally carry the customer’s private belongings. Such assistance may only be offered in good faith, subject to availability and safety.
7.23. Children under the age of twelve may not travel alone. Child passengers must be accompanied by an adult who is legally responsible for them. The company reserves the right to refuse requests for unaccompanied child transfers.
7.24. Requests for baby seats, booster seats, wheelchair transportation, extra luggage, sports equipment, special medical needs, or similar additional services must be declared during the reservation process. Requests made later may not always be accommodated and may incur additional charges.
7.25. The provision of baby seats or special equipment depends on stock and vehicle suitability. If such service is provided, an additional fee may be charged.
7.26. If the transfer is delayed or cancelled due to weather conditions, heavy traffic, road closures, an incorrect address, sudden illness of the driver or passenger, official inspections, vehicle breakdown, or similar reasons, the liability of AYT VIP TRANSFERS may be limited solely to the amount paid for the service. Flight ticket losses, hotel reservations, business losses, travel disruption, non-material damages, or indirect losses may not be claimed from the company.
7.27. If the customer voluntarily cancels the service during the transfer, requests to get off along the route, or wishes to return to the starting point, the company is not obliged to provide such service. Assistance may be provided if operationally possible; however, if it is not possible, no refund shall be made.
7.28. If the customer requests to return to the pick-up point for any reason during the transfer, asks for a route change due to forgotten belongings, or requests that the transfer be rearranged afterward, this shall be entirely at the discretion of AYT VIP TRANSFERS. Failure to meet such requests shall not constitute a breach of contract by the company.
7.29. If one of the passengers or a pre-approved animal transported in the vehicle experiences a health problem during the transfer, the driver may decide to proceed to the nearest appropriate medical facility. In such cases, delays, route changes, and subsequent consequences shall be evaluated only within the scope of the company’s reasonable duty of care.
7.30. The nearest medical facility may be a public or private institution depending on distance, accessibility, and urgency at the relevant time. The customer and passenger accept that the driver may act according to emergency conditions in urgent health situations.
7.31. If requested by the customer, an invoice related to the service shall be sent to the email address or other communication channel provided during the reservation.
8. Force Majeure
The parties may temporarily be unable to fulfill their obligations due to circumstances beyond their control, including natural disasters, floods, earthquakes, storms, heavy snow, fire, epidemics, war, mobilization, terrorism, civil unrest, road closures, strikes, lockouts, official prohibitions, administrative restrictions, communication or infrastructure failures, state of emergency, and similar force majeure events. In such cases, the agreement shall be deemed suspended until the effects of the force majeure cease. Delay or non-performance due to force majeure shall not in itself create a right to compensation.
9. Cancellation Terms and Other Provisions
Certain services purchased under campaigns, promotions, early booking discounts, seasonal offers, or special prices may not be eligible for cancellation, modification, or refund. Refund requests made after the reserved date has passed, situations where the service was not used due to customer-related reasons, and objections made to banks shall only be evaluated together with the concrete transaction records. AYT VIP TRANSFERS reserves the right to review requests where misuse is suspected.
10. Jurisdiction and Applicable Law
The laws of the Republic of Türkiye shall apply to any disputes arising from this agreement. The parties agree that the courts and enforcement offices of the place where the company headquarters is located shall have jurisdiction. The customer’s statutory rights under consumer protection legislation are reserved.
11. Entry into Force
This agreement shall enter into force upon the customer creating an online reservation, giving approval by phone or digital channels, making payment, or actually using the service. Passengers who use the service but whose reservation was made by a third party shall also be deemed to have accepted that the person acting on their behalf has approved this agreement and that it is binding on them.
The customer declares that they have read and understood the entire text, evaluated it together with the transfer date and time, reservation details, passenger transportation rules, and the explanations available on the website, and accepted all terms and conditions.
Any user making a reservation through www.aytviptransfers.com shall be deemed to have read, understood, and accepted these rental terms and the passenger transportation agreement.
